Terms and Conditions of Use

Welcome to the Provost Orchids online store! By accessing and using our site, you agree to the terms and conditions below. Please read them carefully.

1. General
These terms and conditions apply to all orders placed through our website. We reserve the right to modify them at any time without notice. By using our site, you accept the terms in effect at the time of use.

2. Products
We strive to present the orchids and other products as accurately as possible. Images are provided for reference only: as orchids are natural plants, slight variations in colour, size, and shape are possible. Plants are sold out of bloom; the flowers shown are not guaranteed at the time of purchase.

3. Prices
All prices are in Canadian dollars (CAD) and include applicable taxes, unless otherwise stated. Shipping fees, if any, are added to the order total. We reserve the right to change prices at any time, without affecting orders already confirmed.

4. Orders
To place an order, you must provide accurate and complete information. We reserve the right to refuse any order for a valid reason (out of stock, incorrect address, or another issue related to the order). Once your order is confirmed, you will receive a confirmation email with the details of your purchase.

5. Payment
We accept the main payment methods offered at checkout (credit card, Apple Pay, Google Pay, and other options shown at checkout). Payment must be made in full before shipping or pickup. All transactions are secured to protect your personal and payment information.

6. Delivery and pickup
We deliver anywhere in Canada, from spring through autumn. We do not ship plants during the freezing months: the risk to a tropical plant is simply too high, however well it is packed. Local pickup in Laval stays available all year, by appointment. In spring and autumn, when nights drop below 10 °C, a 40-hour heat pack can be added to your order at checkout. Delivery times vary by region and weather conditions; the times indicated are estimates. We are not responsible for delays caused by factors beyond our control (weather, strikes, etc.).
A free local pickup option is also available in Laval, by appointment. The details are specified at checkout.

7. Returns and refunds
Because of the perishable nature of our products, we do not accept returns of orchids, except in the case of a defect or an error on our part. If you receive a damaged or incorrect item, contact us within 48 hours of delivery, with photos. We will do our best to resolve the situation with a replacement or a refund.

8. Warranties
We guarantee that the orchids are healthy at the time of shipping or pickup. We cannot, however, guarantee their survival afterwards, as their well-being depends on growing conditions after delivery.

9. Intellectual property
All content on this site (images, text, graphics, and logos) is protected by intellectual property rights. You may not reproduce, distribute, or use it without our prior written authorization.

10. Data protection
We are committed to protecting the confidentiality of your personal information, in accordance with Quebec's Law 25. See our privacy policy to learn how we collect, use, and protect your data.

11. Governing law
These terms and conditions are governed by and interpreted in accordance with the laws in effect in the province of Quebec. Any dispute will be submitted to the exclusive jurisdiction of the courts of that province.
